Rescission and Termination of Labor Contract
第十八條有下列情形之一的,依照勞動合同法規(guī)定的條件、程序,勞動者可以與用人單位解除固定期限勞動合同、無固定期限勞動合同或者以完成一定工作任務(wù)為期限的勞動合同:
Article 18 Subject to the conditions and procedures set forth in the Labor Contract Law, an employee may rescind the labor contract having a fixed-term, non-fixed-term or term subject to the completion of certain task that such employee has executed with the employer, if any of the following events occurs:
(一)勞動者與用人單位協(xié)商一致的;
(1)the employee and the employer have mutually agreed thereon through negotiation;
(二)勞動者提前30日以書面形式通知用人單位的;
(2)the employee has notified the employer thereof in writing 30 days in advance;
(三)勞動者在試用期內(nèi)提前3日通知用人單位的;
(3)the employee has notified the employer thereof in writing 3 days in advance during the probationary period;
(四)用人單位未按照勞動合同約定提供勞動保護(hù)或者勞動條件的;
(4)the employer has failed to provide the labor protection or work condition as agreed in the labor contract;
(五)用人單位未及時足額支付勞動報酬的;
(5)the employer has failed to pay the work remuneration fully and timely;
(六)用人單位未依法為勞動者繳納社會保險費(fèi)的;
(6)the employer has failed to pay the social insurance premium on behalf of the employees as required by the law;
(七)用人單位的規(guī)章制度違反法律、法規(guī)的規(guī)定,損害勞動者權(quán)益的;
(7)the employer’s bylaws and rules violate laws and regulations and impair the rights and interests of the employee;
(八)用人單位以欺詐、脅迫的手段或者乘人之危,使勞動者在違背真實(shí)意思的情況下訂立或者變更勞動合同的;
(8)the employer adopts fraudulent or threatening means or takes advantage of the employee being in distress to force the employee to sign or revise the labor contract in contrary to the real intention of the employee;
(九)用人單位在勞動合同中免除自己的法定責(zé)任、排除勞動者權(quán)利的;
(9)the employer exempts itself from the statutory obligations and excludes the rights of the employee in the labor contract;
(十)用人單位違反法律、行政法規(guī)強(qiáng)制性規(guī)定的;
(10)the employer is in violation of the statutory provisions of laws and regulations;
(十一)用人單位以暴力、威脅或者非法限制人身自由的手段強(qiáng)迫勞動者勞動的;
(11)the employer has forced the employee to work by means of violence, threatening or illegal limitation of the personal freedom;
(十二)用人單位違章指揮、強(qiáng)令冒險作業(yè)危及勞動者人身安全的;
(12)the employer has incompliantly directed or forcefully ordered the employee to work under dangers, endangering the personal safety of the employee; or
(十三)法律、行政法規(guī)規(guī)定勞動者可以解除勞動合同的其他情形。
(13)any other event where the employee may rescind the labor contract under laws and regulations.
第十九條有下列情形之一的,依照勞動合同法規(guī)定的條件、程序,用人單位可以與勞動者解除固定期限勞動合同、無固定期限勞動合同或者以完成一定工作任務(wù)為期限的勞動合同:
Article 19 An employer may rescind its labor contract with a fixed-term, non-fixed-term or term subject to completion of certain task signed with an employee according to the conditions and procedures set forth in the Labor Contract Law, if:
(一)用人單位與勞動者協(xié)商一致的;
(1)the employer and the employee reach an agreement through negotiation;
(二)勞動者在試用期間被證明不符合錄用條件的.;
(2)the employee proves to be disqualified for recruitment during probationary period;
(三)勞動者嚴(yán)重違反用人單位的規(guī)章制度的;
(3)the employee materially violates the by-laws and rules of the employer;
(四)勞動者嚴(yán)重失職,營私舞弊,給用人單位造成重大損害的;
(4)the employee is in gross negligence and malpractice, which causes material damages to the employer;
(五)勞動者同時與其他用人單位建立勞動關(guān)系,對完成本單位的工作任務(wù)造成嚴(yán)重影響,或者經(jīng)用人單位提出,拒不改正的;
(5)the employee establishes employment relation with any other employer concurrently, which materially impedes the completion of tasks at the current employer or fails to be rectified after the notification by the current employer;
(六)勞動者以欺詐、脅迫的手段或者乘人之危,使用人單位在違背真實(shí)意思的情況下訂立或者變更勞動合同的;
(6)the employee adopts fraudulent or threatening means or takes advantage of the employer being in distress to cause the labor contract to be executed or revised in contrary to the real intention of the employer;

第二篇:解除勞動合同協(xié)議
企業(yè)名稱(甲方): 職工姓名(乙方):
甲乙雙方于2002年11月28日訂立了為期3年的勞動合同,現(xiàn)經(jīng)乙方提出,并雙方協(xié)商一致,同意解除勞動合同,并達(dá)成如下協(xié)議:
1、甲乙雙方從簽訂本協(xié)議起,原勞動合同即行解除,甲乙雙方根據(jù)規(guī)定辦理相關(guān)手續(xù);
2、甲方同意給予乙方解除勞動合同經(jīng)濟(jì)補(bǔ)償金7000元;
3、甲乙雙方同意原勞動合同解除后不再提出或威脅提出針對
對方的任何勞動仲裁、訴訟或索賠請求;
4、本協(xié)議自雙方簽字之日起生效;
5、本協(xié)議一式二份,雙方各執(zhí)一份,具有同等法律效力。
6、本協(xié)議以中英文書就,如中英文版本之間存在任何差異,以中
文版本為準(zhǔn).
7.本協(xié)議按中國法律解釋,受中國法律管轄.
