        王小姐是一家廣告公司的銷售主管,由于在一筆銷售提成款的問題上與公司產(chǎn)生分歧,她一氣之下于2009年4月20日向公司發(fā)送了一封電子郵件: “我決定今天辭職,希望公司可以安排交接人員于5月19日前將我的工作交接完畢?!比肆Y源部門直到5月10日才作出接受辭職的答復(fù)。王小姐十分意外,本以為公司會挽留她,沒想到公司竟然同意了自己的辭職請求。深感懊悔的王小姐向當(dāng)?shù)貏趧訝幾h仲裁委員會提出仲裁申請。她認(rèn)為,電子郵件的辭職申請只是自己一個意向表示,應(yīng)當(dāng)是書面申請才能構(gòu)成正式的辭職信。公司發(fā)出的這一決定顯然是單方面終止與自己的勞動關(guān)系,因此要求公司繼續(xù)履行原勞動合同。

        那么,電子郵件的辭職申請具有法律效力嗎?辭職申請以什么形式最合適? 分 析:
