電子郵件辭職可視為書面通知。
但是你需要做：

【辭職報告格式】
(一)辭職報告標(biāo)題

王小姐是一家廣告公司的銷售主管，由于在一筆銷售提成款的問題上與公司產(chǎn)生分歧，她一氣之下于2009年4月20日向公司發(fā)送了一封電子郵件： “我決定今天辭職，希望公司可以安排交接人員于5月19日前將我的工作交接完畢?！比肆Y源部門直到5月10日才作出接受辭職的答復(fù)。王小姐十分意外，本以為公司會挽留她，沒想到公司竟然同意了自己的辭職請求。深感懊悔的王小姐向當(dāng)?shù)貏趧訝幾h仲裁委員會提出仲裁申請。她認(rèn)為，電子郵件的辭職申請只是自己一個意向表示，應(yīng)當(dāng)是書面申請才能構(gòu)成正式的辭職信。公司發(fā)出的這一決定顯然是單方面終止與自己的勞動關(guān)系，因此要求公司繼續(xù)履行原勞動合同。
那么，電子郵件的辭職申請具有法律效力嗎?辭職申請以什么形式最合適? 分 析：
電子郵件作為即時通訊的一種形式，具有證據(jù)特點中的 “關(guān)聯(lián)性”。通過技術(shù)手段獲取，或者通過公證機(jī)關(guān)對電子郵件內(nèi)容及源代碼等進(jìn)行公證取證，電子郵件就具備了證據(jù)的 “客觀性”與 “合法性”。具備了 “三性”的證據(jù)在法律上具備合法效力，也可以在訴訟中作為證據(jù)使用。本案中，王小姐在郵件中明確作出解除勞動合同的意思表示，自此意思表示送達(dá)公司時即產(chǎn)生了法律效力。因此，王小姐的這封郵件完全可以起到書面辭職申請的效力.
