第一篇：雇傭協(xié)議書
甲方：___總務(wù)處
乙方：
為加強(qiáng)學(xué)校水電管理，提高水電管理人員的服務(wù)意識(shí)、服務(wù)質(zhì)量、服務(wù)效率，確保師生正常用水用電的需求，最大限度地減少用水用電的浪費(fèi)，甲方聘請(qǐng)乙方為學(xué)校水電工工作人員，為維護(hù)甲、乙雙方權(quán)利，經(jīng)協(xié)商，雙方達(dá)成如下協(xié)議：
一、乙方工作職責(zé)：

四、安全責(zé)任：

五、其他事項(xiàng)：

四、 雇傭合同的解除和終止

4.1 合同期滿雙方不再續(xù)簽或者雙方約定的合同終止條件出現(xiàn)時(shí)，雇傭合同即終止。

4.2 經(jīng)合同雙方當(dāng)事人協(xié)商一致，本合同可以解除。

Party A may extend Party’s B’s working hours on the basis of mutual agreement, and party B shall get corresponding deferred holidays or paid for the extended work hours in accordance with relevant laws and regulations.
三、 報(bào)酬及其他福利

After the probation, Party A shall provide Party B with a monthly housing allowance of RMB5,000.00. Party A shall provide the invoice of rent payment for reimbursement. The monthly date for reimbursement is on the 8th day of each month. If the 8th day of the month falls in the weekend or holiday, the payment shall be brought forward to the nearest weekday. 3.4 當(dāng)乙方的工作任務(wù)發(fā)生變化時(shí)，甲方可按規(guī)定調(diào)整其相應(yīng)的報(bào)酬。乙方接受新的工作任務(wù)后，即視作接受甲方按照該工作任務(wù)重新確定的報(bào)酬。
Party B’s labor remuneration will be adjusted in case Party A adjusts Party B’s job responsibilities. Accepting thenew position is regarded as accepting the adjusted salary.
3.5 乙方應(yīng)遵守國(guó)家及地方的稅法制度，自行繳納其個(gè)人收入的個(gè)人所得稅，甲方無(wú)義務(wù)為其代繳。

3.6 乙方在合同期內(nèi)享受中國(guó)法律規(guī)定的節(jié)日，公休假日，另外公司每年為其提供5天的帶薪休假。

四、 雇傭合同的解除和終止
Ⅳ Contract Cancellation and Termination
4.1 合同期滿雙方不再續(xù)簽或者雙方約定的合同終止條件出現(xiàn)時(shí)，雇傭合同即終止。
This contract shall be terminated once it expires and both parties do not extend the contract.
4.2 經(jīng)合同雙方當(dāng)事人協(xié)商一致，本合同可以解除。
The contract may be canceled based on both parties’ mutual negotiation.
4.3 乙方應(yīng)遵守中國(guó)的法律、法規(guī)及有關(guān)規(guī)定，乙方如違反上述規(guī)定，甲方有權(quán)即時(shí)解除合同；乙方因健康原因，經(jīng)醫(yī)生證明連續(xù)病休15工作日后仍不能繼續(xù)工作，甲方有權(quán)提前終止合同。
Party B should abide by China laws, decrees and related regulations and Party A’s working systems. During the duration, Party A is entitled to cancel the contract in case Party B violates China laws and decrees, and terminate the contract before expiration in case Party B cannotresume his or her work for health reasons after the medical certification of continuous sick rest for 15 working days.
4.4 乙方因歸國(guó)或其他私人原因未正常出勤且超過(guò)十天且未向甲方做出書面說(shuō)明的，本合同自動(dòng)終止。 The contract will automatically terminate in case Party B is absent for over 10 days without written explanation due to homecoming or other private reasons.
4.5 乙方被證明無(wú)法完成本合同項(xiàng)下的工作任務(wù)，甲方有權(quán)隨時(shí)解除本合同。
In case Party B is proved to be not competent for the work under the contract, Party A is entitled to cancel the contract at any time.
4.6 乙方應(yīng)嚴(yán)格遵守甲方的工作規(guī)定以及規(guī)章制度，盡職盡責(zé)，否則，甲方有權(quán)隨時(shí)解除合同并追究因此而造成的經(jīng)濟(jì)損失，并有權(quán)對(duì)所造成的經(jīng)濟(jì)損失在乙方的報(bào)酬中作相應(yīng)扣除。
Party B should abide by Party A’s working systems, rules and regulations. Otherwise, Party A is entitled to cancel the contract and claim a corresponding compensation of any economic loss from Party B’s payment.
4.7 乙方有權(quán)提前30 日以書面形式通知甲方解除本合同，在試用期內(nèi)提前3日通知甲方即可解除。

五、其他事項(xiàng)

5.1 其他未盡事宜，雙方可參照甲方公司內(nèi)部的相關(guān)規(guī)章制度執(zhí)行。

5.2 甲乙雙方均應(yīng)遵守本合同之約定，任何一方違約，非違約方均有權(quán)要求違約方承擔(dān)相應(yīng)的損失。

5.3 甲乙雙方在本合同的執(zhí)行中如有爭(zhēng)議，可協(xié)商解決。

5.4 本合同分為中英兩種文本，每種文本具有相同的法律效力；如兩種文本產(chǎn)生沖突，則中文文本為作準(zhǔn)文本。

八、乙方在工作期間內(nèi)每天對(duì)車輛進(jìn)行保養(yǎng)、擦洗；每天對(duì)車輛進(jìn)行檢查，保持車輛狀況良好再行駛。絕不帶著毛病上道。如不遵守交通規(guī)則，而發(fā)生交通事故，責(zé)任都由乙方來(lái)承擔(dān)，甲方概不負(fù)任何責(zé)任。
九、乙方必須按照裝載機(jī)的操作規(guī)程嚴(yán)格規(guī)范操作，如因違規(guī)操作造成乙方及他人的人身安全及健康問(wèn)題，由乙方自行負(fù)責(zé)，與甲方無(wú)關(guān)。
十、工作范圍之外，如果乙方外出，發(fā)生的任何意外，由乙方自行承擔(dān)，甲方概不負(fù)責(zé)。
十一、合同的變更、終止和解除
1、崗位聘任合同簽訂后，甲、乙雙方必須全面履行合同規(guī)定的義務(wù)，任何一方不得擅自變更合同。確需變更的，雙方應(yīng)協(xié)商一致，并按原簽訂程序辦理。雙方未達(dá)成一致意見的，原合同效力不變。
2、有下列情況之一的，甲方可以隨時(shí)解除聘任合同：
（1）乙方在工作期間不勝任崗位要求；

第四篇：雇傭合同
_________國(guó)_________公司(以下簡(jiǎn)稱甲方)與外派海員_________(海員證號(hào)碼_________，以下簡(jiǎn)稱乙方)，就甲方雇傭乙方到其所屬的_________輪擔(dān)任_________(職務(wù))工作，經(jīng)雙方協(xié)商達(dá)成如下協(xié)議：
一、聘用期限

三、工作時(shí)間及加班費(fèi)
乙方通常工作時(shí)間為每天8小時(shí)，每周40小時(shí)，星期六、星期日為固定加班，每周56小時(shí)為正常工作時(shí)間，超過(guò)56小時(shí)之外的工作為額外加班。但通常情況下，每24小時(shí)內(nèi)乙方應(yīng)至少連續(xù)休息8小時(shí)。如確因工作原因不能保證，該情況每七天內(nèi)只能出現(xiàn)一次。
乙方如系持證高級(jí)海員則只有固定加班費(fèi)，如系普通海員，除固定加班費(fèi)外，額外加班時(shí)間應(yīng)按小時(shí)支付費(fèi)用。
中國(guó)國(guó)內(nèi)法定節(jié)日每年10天(春節(jié)3天，五一節(jié)3天，元旦1天，國(guó)慶節(jié)3天)，乙方在上述法定節(jié)日的工資按雙倍日基薪計(jì)算。
四、伙食費(fèi)
乙方的伙食費(fèi)標(biāo)準(zhǔn)為每天不低于4.5美元，具體的食物和物品供應(yīng)依據(jù)甲方規(guī)定。
五、勞保用品
甲方按附件2的標(biāo)準(zhǔn)，為乙方提供安全生產(chǎn)所必須的勞保用品。
六、醫(yī)療及病假工資
乙方在合同期內(nèi)受傷或生病，甲方負(fù)責(zé)承擔(dān)住院、治療、食宿等一切費(fèi)用，并發(fā)給基本工資。如經(jīng)一年的治療后乙方仍不能康復(fù)，甲方可按照保賠協(xié)議的規(guī)定，一次性支付乙方費(fèi)用后免責(zé)。
七、傷亡保賠
甲方按不低于香港雇員賠償條例(香港法規(guī)282章)的規(guī)定標(biāo)準(zhǔn)，向有聲譽(yù)的船東互保協(xié)會(huì)投保乙方自離開中國(guó)國(guó)境起至返回中國(guó)國(guó)境止的一切人身意外(包括疾病)險(xiǎn)，并負(fù)責(zé)事后追償。甲方保證將所有賠償如數(shù)交付派出乙方的代理公司，并由代理公司全數(shù)交還乙方或乙方的法定繼承人。
如乙方在合同期內(nèi)死亡，甲方除按上述保賠標(biāo)準(zhǔn)賠償外，還須付清乙方所有應(yīng)得收入、返還遺物、妥善安置骨灰并支付喪葬費(fèi)。
八、航行區(qū)域
乙方服務(wù)的船舶應(yīng)在_________航區(qū)航行，如需要改變航區(qū)，應(yīng)事先與乙方代理公司及乙方商量。
如甲方的船舶需駛往戰(zhàn)爭(zhēng)或類似于戰(zhàn)爭(zhēng)的區(qū)域或有戰(zhàn)爭(zhēng)危險(xiǎn)的區(qū)域，甲方須與乙方協(xié)商一致，并對(duì)乙方的基薪和本合同第七條款中的所有保險(xiǎn)和賠償加倍。如乙方不同意航行，甲方負(fù)責(zé)將乙方轉(zhuǎn)船或安排回國(guó)。
戰(zhàn)爭(zhēng)或類似于戰(zhàn)爭(zhēng)的區(qū)域或有戰(zhàn)爭(zhēng)危險(xiǎn)的區(qū)域的界定以本合同第七款的船東互保協(xié)會(huì)的最新規(guī)定為準(zhǔn)。
九、登船及遣返費(fèi)用
甲方負(fù)責(zé)乙方因登船產(chǎn)生的費(fèi)用，但乙方在船發(fā)生棄船、漏船事件時(shí)，需自行負(fù)擔(dān)上船的費(fèi)用。
甲方負(fù)擔(dān)乙方下述情況的遣返費(fèi)用：合同到期;因病或因傷提前結(jié)束合同;因雇主原因結(jié)束雇傭合同;船舶滅失、擱淺或賣船;船舶被扣超過(guò)14天;航程中配偶、子女或父母生命垂?；蛩劳?。但甲方不負(fù)擔(dān)下述情況的遣返費(fèi)用：乙方要求提前結(jié)束合同;乙方漏船、棄船;乙方因違約行為、違法行為以及任何不當(dāng)行為而遭遣返。
十、規(guī)章制度的遵循
乙方應(yīng)誠(chéng)實(shí)、守信，恪盡職守，服從船長(zhǎng)或上級(jí)的合理指令，并遵守以下規(guī)定：履行自己的崗位職責(zé);不能保存任何兇器或槍；不得有任何不文明或不健康的行為，如吸毒、打架、酗酒、吵架等;遵守雇主為船舶正常航行而制定的規(guī)章制度，包括安全制度。
十一、合同終止及解雇費(fèi)
甲乙雙方均可提前一個(gè)月書面要求提前解除合同。
甲方因船舶滅失、擱淺、賣船等不可抗力作用，可提前解除與乙方的合同，但需支付乙方解雇費(fèi)用，費(fèi)用標(biāo)準(zhǔn)為：乙方在船工作不足6個(gè)月，發(fā)給2個(gè)月的工資;超過(guò)6個(gè)月，發(fā)給1個(gè)月的工資。如不可抗力作用導(dǎo)致乙方物品損害或滅失，甲方應(yīng)予以賠償，但數(shù)額不超過(guò)_________美元。
乙方違法或有等嚴(yán)重或?qū)嵸|(zhì)性違約行為時(shí)，甲方可要求提前解除合同，并不需要承擔(dān)責(zé)任。
十二、爭(zhēng)議處理
甲乙雙方在履行合同過(guò)程中產(chǎn)生的爭(zhēng)議，首先應(yīng)由甲乙雙方協(xié)商解決，乙方的代理公司有權(quán)代表乙方及家屬出面協(xié)調(diào)。如果協(xié)商不成，凡因本合同引起的或與本合同有關(guān)的任何爭(zhēng)議均應(yīng)提交香港國(guó)際仲裁中心，按照該中心有效的仲裁規(guī)則進(jìn)行仲裁。仲裁為終局裁決，對(duì)雙方均有約束力。
